Article 1 — The seller
The products and services are sold by Marouan El Mekawy, sole trader, 1 rue Gisèle Halimi, 93140 Bondy, SIREN 913 473 039, hereinafter “Piklo”. Contact: bonjour@piklostudio.com.
Article 2 — Our products
Piklo creates personalised illustrated books for children from the characters and information provided by the customer. Three offers are available.
The single digital book, priced at €8.90. It grants permanent access to read the book in the Piklo app.
The digital subscription, priced at €25 per month. It entitles the customer to create four personalised books a month, available to read in the app. The subscriber enters their characters and their child’s tastes once, then each month finds a menu of the planned themes, which they can edit. The subscription has no fixed term and is cancellable at any time.
The printed book, delivery included, with a price that decreases with the number of books in a single order: €39.90 per book for one book, €34.90 per book for two books, and €30.90 per book from three books onwards. Digital access to read the ordered book is included.
Article 3 — Prices
Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code. For the printed book, delivery costs are included in the displayed price within the covered delivery area. Piklo reserves the right to change its prices at any time, it being understood that the applicable price is the one in force when the order is confirmed.
Article 4 — Order and payment
The order is placed directly on the site. Payment is made online by card via our secure payment provider Stripe. Piklo never has access to the customer’s card details. The order is confirmed once payment is confirmed.
For the subscription, the €25 amount is charged each month by Stripe, on the anniversary date of the sign-up, until the customer cancels.
Article 5 — Delivery
The digital book and the subscription books are available in the app as soon as their generation is complete, which occurs within a few minutes of the order.
The printed book is made to order by our printing partner and shipped to the address given by the customer. Delivery is offered in France and across the European Union. The indicative production and delivery time is seven to fourteen working days depending on the destination.
Article 6 — Right of withdrawal
The right of withdrawal applies differently depending on the product, because of the personalised nature of the books.
Single digital book. As the content is a personalised digital good, the customer expressly acknowledges that by validating their book from their personal area, they request its immediate supply and waive their right of withdrawal, in accordance with article L.221-28 of the French Consumer Code. As long as the customer has not validated their book, they have fourteen days from purchase to request cancellation and a refund.
Subscription. The customer may cancel at any time, without charge or justification, from their personal area. Cancellation takes effect at the end of the current monthly period already paid for. Books already generated during that period remain accessible. No partial refund is due for a started month, since the corresponding books have been made available.
Printed book. As a personalised good made to the customer’s specifications, the right of withdrawal does not apply once production has begun, in accordance with article L.221-28 of the French Consumer Code. As long as the order has not been sent to production, the customer may cancel it and be refunded.
Article 7 — Gift codes
Piklo offers gift codes giving access to the creation of a book. The code is activated by its recipient from the app. Once activated, the code is deemed used and can be neither refunded nor reused. Gift codes cannot be exchanged for cash.
Article 8 — Intellectual property
The books created are intended for the customer’s personal and family use. Piklo retains intellectual property over the templates, the graphic style and the creation technology. The customer has a personal right of use over the personalised book they ordered. Any commercial exploitation or resale is prohibited.
Article 9 — Personal data
The processing of personal data, in particular the photographs used to create the characters, is described in our privacy policy, accessible from the site.
Article 10 — Liability
Piklo undertakes to use all means to ensure the quality of its books. Piklo cannot be held liable for misuse of the service by the customer, in particular the provision of poor-quality photographs affecting the result, or for temporary unavailability of the service for maintenance.
Article 11 — Consumer mediation
In accordance with articles L.611-1 et seq. of the French Consumer Code, a consumer customer has the right to use a consumer mediator free of charge to seek an amicable resolution of a dispute with Piklo, after first sending a written complaint that has gone without a satisfactory reply.
